Short-term and Extended Stay Rentals- Communications Hill Properties, San Jose, CA, USA TERMS AND CONDITIONS (Revised January, 18, 2013)
If you wish to rent a property from San Jose Executive Housing, a full and binding legal contract will be drawn up and signed by both you and the company.
Prior to signing a contract with us, you may wish to book one of our properties. Reservations may be made online.
By providing your credit card information and/or making payment for the Security Reservation Deposit or for the full rent, you agree that you are 18 years old or older and have fully agreed to and accepted the following Terms and Conditions, including the Cancellation Policy (See Section 2 below.) You also agree that this document to be an addendum to our contract.
The following Terms and Conditions will apply to temporary or short-term as well as extended stay rentals between PMI ENTERPRISES, LLC. DBA: SAN JOSE EXECUTIVE HOUSING (hereinafter “the Landlord”) and the RENTER (hereinafter “the Guest”.) These rental properties are located in San Jose, CA, US.
RESERVATION SECURITY DEPOSIT
A Reservation Security Deposit is due at the time of making reservation. The deposit and/or the rent (including departure cleanings, fees and transient tax) is to be paid by cash or credit card through PayPal or our Merchant Account unless another arrangement has been made. Please Note – Payment of the Reservation Security Deposit does not guarantee the agreement until a lease is fully executed and signed by both parties.
This reservation deposit will convert to rent after we receive the balance of the rent payment including additional fees.
SECURITY DAMAGE DEPOSIT
When signing the rental contract, you agree to be liable for any damage to the Premises due to willful or inadvertent negligence or unauthorized extension of the agreement term. You also agree that the costs for damages may be charged to your credit card.
You may choose to purchase your own property damage insurance policy or allow us to pre- authorize your credit card. With a property damage insurance policy, we will waive the Security Damage Deposit and only pre-authorize your credit card for up to $500 (five hundred dollars.) With property damage insurance in effect, you will be responsible for the first $500 of repair costs as well as any costs not covered by the insurance policy.
Minimum Property Damage Insurance Requirements:
- Condo & Apartment: $1500
You may purchase property damage insurance through a company of your choice or we can refer you to a suitable company. The average cost of purchasing a $1500 to $5000 property damage policy starts at $49 to $89. Proof of insurance must be provided at least 24 hours before you take occupancy.
We may provide the property damage coverage at no charge to you, or we may purchase it for you and add the premium to your rental fee. Please inquire for details.

Without a property damage policy in place, we will pre-authorize your credit card for a minimum of $500 to maximum of $5000. Your credit card will be charged for any additional charges as outlined in the contract or pursuant to Civil Code Section 1950.5.
The Security Damage Deposit authorization will be processed and lifted or refunded within 14 days of your departure if all charges accrued during the stay are paid prior to departure and no damage is done to the unit or its contents, beyond normal wear and tear. The contract lists additional charges, which may be incurred.
An advance payment equal to 100% of the rental rate minus the security reservation deposit, applicable transient tax and all additional and/or miscellaneous fees is required by 4 p.m. PST 60 (sixty) days before taking occupancy of the unit. The total miscellaneous and/or additional fees are part of the rent and to be considered as the rent, and the transient tax is applied to the total amount.
If full payment is not received on the due date by 4 p.m. PST we reserve the right to cancel the reservation. Without advance cancellation in writing, submitted on or before the due date for payment, we reserve the right to charge for rent, transient tax, and all additional and/or miscellaneous fees after 4 p.m. PST on the due date or 60 days before the occupancy date begins.
CANCELLATIONS MUST BE SUBMITTED TO THE LANDLORD IN WRITING. The Cancellation may be submitted to us via mail, fax, or email. Our mailing address is SJEH P.O. Box 18961 San Jose, CA 95158 U.S.A. Cancellations may be faxed or emailed also.
Your security reservation deposit is $500 which coverts to rent 60 days before your move in date. By making payment for renting our property, you confirm that you have read, understand and agree with the following cancellation and refund policy.
For cancellations 60 days or more before your check-in date, 100% of the Security Reservation Deposit is forfeited.
For cancellations between 59 (by 4 p.m.) before your check in date, 100% of the Security Reservation Deposit is forfeited unless dates can be re-rented and confirmed.
Cancellation less than 60 days before your check in date the rent and tax and additional fees are forfeited, unless the property is re-rented and confirmed, in which case: If the rental period is re-rented at the same rate as your original Agreement, then all rent, taxes, and additional fees minus a $500 administration and cancellation fee will be refunded.
- If the re-rental rate is made at a lower rate than the original Tenant agreed to, the refunded amount will be the difference between the original rental rate and the new rental rate minus $500 administration and cancellation fee.
- If you choose to pay the full rent, tax and fees early or at least 120 days from check in date, and receive a discount equal to your transient tax, your cancellation policy is based on section B above.
We will make every good faith effort to re-rent the Premises at the original rental rate. Any transaction fee charged by bank and credit card companies for processing the refund is non-refundable.
If notice of cancellation is not received in writing, we reserve the right to charge your credit card after 4 p.m. on the 60 th. day before the check in date.
Rates are subject to change without notice unless a contract has been fully completed with requested information, initialed on all pages and signed by both the Tenant and the Landlord.
Any reservation obtained under false pretense will be subject to forfeiture of advance payment, deposit and/or rental money, and the party will not be permitted to check in.
Any exceptions to the above mentioned policies must be approved in advance and stated in the contract.
INCLUSIVE FEES – Rental rates include the following:
Gas, water, electricity, Internet service, cable television service, garbage pickup, and utility fees are included in the rental rate.
CHECK-IN AND CHECKOUT
Check-in time is 3:00PM on arrival date. Checkout time is 11:00AM on departure date. Early arrivals and late checkout may be accommodated upon request, but cannot be guaranteed. If you have used a special offer or Super Deal, your Check In and Check Out time may be different. Please review the ad or offer for additional information.
Cash or credit card payment for all additional charges incurred during your stay is due at Checkout.
