NOTE: This is not a contract. This document is intended for information purposes only. If you wish to rent a property from San Jose Executive Housing, a full and binding legal contract will be drawn up and signed by both you and the company.

By providing your credit card information and/or making payment for the Security Reservation Deposit you agree that you have fully agreed to and accepted the following Terms and Conditions, including the Cancellation Policy (See Section 2 below.)

The following Terms and Conditions will apply to temporary or short-term as well as extended stay rentals of less than 90 days between SAN JOSE EXECUTIVE HOUSING (hereinafter "the Landlord") and the RENTER (hereinafter “the
Tenant
”.) These rental properties are located in the Communications Hill area in South San Jose at the following addresses:

Tenants signing a rental contract must be 18 years of age or older.

RESERVATION SECURITY DEPOSIT

A Reservation Security Deposit in the amount listed on our website’s “Rates and Offers” page is due within 24 hours of booking in order to confirm your reservation. The deposit is to be paid by cash or credit card through our Intuit Merchant Account unless another arrangement has been made. The rent is also to be paid through our Intuit Merchant Account unless alternative arrangements have been made.

Please Note – Payment of the Reservation Security Deposit does not guarantee the agreement until a lease is fully executed and signed by both parties.

This reservation deposit will convert to rent after we receive the balance of the rent payment including additional fees.

SECURITY DAMAGE DEPOSIT

When signing the rental contract, you agree to be liable for any damage to the Premises due to willful or inadvertent negligence or unauthorized extension of the agreement term. You also agree that the costs for damages may be charged to your credit card.

You may choose to purchase your own property damage insurance policy or allow us to pre- authorize your credit card. With a property damage insurance policy, we will waive the Security Damage Deposit and may only pre-authorize your credit card for up to $500 (five hundred dollars.) With property damage insurance in effect, you will be responsible for the first $500 of repair costs as well as any costs not covered by the insurance policy. 

Minimum Property Damage Insurance Requirements:

You may purchase property damage insurance through a company of your choice or we can refer you to a suitable company. The average cost of purchasing a $3000 to $5000 property damage policy starts at $39 to $59. Proof of insurance must be provided at least 24 hours before you take occupancy.

Without a property damage policy in place, we will pre-authorize your credit card for a minimum of $3000 for the Lancaster Gate Condo or $5000 for the Tuscany Hills Townhome. Your credit card will be charged for any additional charges as outlined in the contract or pursuant to Civil Code Section 1950.5.

The Security Damage Deposit authorization will be processed and lifted or refunded within 14 days of your departure if all charges accrued during the stay are paid prior to departure and no damage is done to the unit or its contents, beyond normal wear and tear. The contract lists additional charges which may be incurred.

RENT

Current rates are listed on our website.

An advance payment equal to 100% of the rental rate, applicable transient tax and all additional and/or miscellaneous fees is required by 4 p.m. PST 45 (forty five) days before taking occupancy of the unit. The total miscellaneous and/or additional fees are part of the rent and to be considered as the rent, and the transient tax is applied to the total amount. Tips and housekeeping fees are not subject to tax. Tips for housekeepers are optional.

If full payment is not received on the due date by 4 p.m. PST we reserve the right to cancel the reservation. Without advance cancellation in writing, submitted on or before the due date for payment, we reserve the right to charge rent, transient tax and all additional and/or miscellaneous fees after 4 p.m. PST on the due date or 45 days before the occupancy date begins.

CANCELLATIONS

CANCELLATIONS MUST BE SUBMITTED TO THE LANDLORD IN WRITING. The Cancellation may be submitted to us via mail, fax or email. Our mailing address is SJEH P.O. Box 18961 San Jose, CA 95158 U.S.A. Our fax number is 408-265-4275 and our email address is Info@SanJoseExecutiveHousing.com.

  1. For cancellations 60 days or more before your check-in date, 50% of the Security Reservation Deposit is forfeited.
  2. For cancellations between 59 and 45 days (by 4 p.m.) before your check in date, 100% of the Security Reservation Deposit is forfeited unless dates can be re-rented and confirmed.
  3. For cancellation less than 45 days before your check in date, the rent and tax and additional fees are forfeited, unless the property is re-rented and confirmed, in which case:
    1. If the rental period is re-rented at the same rate as your original Agreement, then all rent, taxes, and additional fees minus a $250 administration and cancellation fee will be refunded.
    2. If the re-rental rate is made at a lower rate than the original Tenant agreed to, the refunded amount will be the difference between the original rental rate and the new rental rate minus $125 administration and cancellation fee.

    We will make every good faith effort to re-rent the Premises at the original rental rate. Any transaction fee charged by bank and credit card companies for processing the refund is non-refundable.

  4. If notice of cancellation is not received in writing, we reserve the right to charge your credit card after 4 p.m. on the 45th day before the check in date the balance due for rent, tax, additional fees. Please note that the rent, tax, and additional fees are due on or before 45 days prior to the check in date.
  5. Early departure does not warrant any refund of rent. Cancellations or changes that result in a shortened stay, or that are made within 45 days following the check in date, forfeit the full advance rent payment, tax and any additional fees.

RENTAL TERMS

MAXIMUM OCCUPANCY

Our rates cover up to 7 guests staying at the Tuscany Hills Townhome and 5 guests at the Lancaster Gate Condo. Individuals over the age of 4 years are considered guests. An additional charge per person per night for each additional guest will be added to the contract. You are responsible for informing us if there will be other occasional guests, and the approximate number of nights they will be staying at the property.

MINIMUM NIGHT PURCHASE

A minimum 2 nights purchase is required unless the unit is offered or rented for events or small gatherings on an hourly basis.  Longer minimum purchases may be required during holiday periods.

RATE CHANGES

Rates are subject to change without notice unless a contract has been fully completed with requested information, initialed on all pages and signed by both the Tenant and the Landlord.

FALSIFIED RESERVATIONS

Any reservation obtained under false pretense will be subject to forfeiture of advance payment, deposit and/or rental money, and the party will not be permitted to check in.

WRITTEN EXCEPTIONS

Any exceptions to the above mentioned policies must be approved in advance and stated in the contract.

INCLUSIVE FEES – Rental rates include the following:

Gas, water, electricity, wireless Internet service, cable television service, landline or Internet telephone service excluding international calls, garbage pickup and utility fees are included in the rental rate unless otherwise listed in the contract. Fax service is available at no charge from our office.

CHECK-IN AND CHECK-OUT

Check-in time is 3:00PM on arrival date. Checkout time is 11:00AM on departure date. Early arrivals and late checkout may be accommodated upon request, but cannot be guaranteed.

Cash or credit card payment for all additional charges is due at Checkout.

ERRORS AND OMISSIONS

We have put forth every effort to ensure that the information on SanJoseExecutiveHousing.com, our brochures, presentation materials, ads, and listings, are accurate. However, we cannot be held responsible for unintended errors or omissions. The Premises that are the subjects of this document are privately owned and changes may have been made to some of the Premises or their contents subsequent to the publishing of the web pages.
