Payment and Cancellation

The following information applies to the short-term or extended stay rentals, also called vacation rental and corporate housing. (Minimum 3 nights, up to 12 months stay)

Making Reservations: Secure the Dates by Reserving the Unit (Section I)

Booking the Unit: Secure the Date and Rate by Booking the Unit (Section II)

Monthly Rental: Rent One Month at a Time (Section III)

Disclosure: The Information you must Disclose (Section V)

I. Making Reservations

Prior to signing a contract to fully book or rent a unit or a property, you may wish to reserve the unit. Reservation allows you to secure the availability without fully booking or renting it. By reserving, you would have a 24 hours to sign the contract and finalize your booking. By making a reservation, you will be able to hold the property until 90 days before the check- in date without booking or signing a contract. A reservation does not lock in the rate. To lock in the rate, you must book the unit. Full payment including rent, fees, applicable taxes is due 90 days before check in.

I a. Reservation Cancellation Policy

Once the 90th day is reached, you may either cancel your reservation or book the property. Your security reservation deposit is $500. If you cancel your reservation, we will retain 100% of your security reservation deposit. Please eliminate your financial risk by obtaining travel insurance.

If you are booking within 90 days of your check-in date, the reservation is limited to 24 hours. This allows you to lock in the date and rate, review and sign the contract and make full payment. When you book the unit within 90 days of your check-in date, the rent, tax, and additional fees must all be paid at booking. By booking, we lock in your rate and any rate change won’t affect your contract.

Signing a contract is not required unless you are making a reservation within 90 days of your check in.

If you are making a reservation, you may request a copy of the contract, check-in, checkout, and house rules to review. Failure to request or review the contract or the house-rules is not grounds for receiving a refund. By making a reservation, we agree to hold the unit for a certain period until you book, review the contract, and pay in full.

By making a payment for security reservation deposit or toward the rent, and for renting any of our units/properties, you represent to us that you are 18 years old or older and have fully read, understood and agreed to and accepted the Terms and Conditions listed above or below.

II. Booking a Unit

To lock in your rate, you must book the property. If you wish to book or rent a unit from San Jose Executive Housing, a full and binding legal contract will be drawn up and signed by both you and the company.

Full payment for rent, fees and applicable tax is due at the time of booking regardless of when you book. The $500 Reservation Deposit is credited to refundable security damage deposit once you book the unit. You may book prior to the start of the 90-day period or within 90 days from your check-in date.

II a. Booking Cancellation Policy

For cancellations made fewer than 90 days before your check-in date, we retain the entire amount of rent, and additional fees excluding cleaning fee and transient tax if applicable, unless the property is re-rented and confirmed. The transient tax and cleaning fee will be refunded when you cancel and don’t take occupancy of the unit. If the property is re-rented and confirmed at the same rental rate as you agreed to pay, then we will refund all rent, and additional fees that you have paid, minus (i) a $1000 administration and cancellation fee, and (ii) any transaction fee charged by bank and credit card companies in connection with your booking and/or renting of the property. If the re-rental rate is lower rate than the rental rate that you agreed to pay, then we will refund to you an amount equal to the difference between (a) the total rent that you paid and (b) the total rent due under the replacement contract, minus (i) a $1000 administration and cancellation fee, and (ii) any transaction fee charged by bank and credit card companies in connection with your booking and/or renting of the property.

II b. Early Booking and Online Booking Cancellation Policy

We may offer the option to pay in full to receive an additional discount equal to your transient tax or cleaning fee if your reservation date is more than 120 days from check in date. You may also take advantage of the availability of special rates and/or offers to book the unit and pay in full before the 90-day period begins. In either instance, with any other offer that requires a full payment at the time of booking; your cancellation policy is based on what has been listed under section II a. above.

III. Monthly Rental (Month-to-Month Rental Payment Terms and Conditions)

If you would like to take advantage of our month-to-month rental packages, the following terms and conditions also apply:

III a. Reservation and Cancellation of a Month-to-Month Rental

Once the 90th day is reached, you may either cancel your reservation or book the property. Your security reservation deposit is $500. If you cancel your reservation, 100% of your security reservation deposit is forfeited. Please eliminate your financial risk by obtaining travel insurance

For cancellations of less than 90 days before your check-in date, the rent, tax, and additional fees are forfeited, unless the property is re-rented and confirmed. If the property is re-rented and confirmed at the same rate as your original Agreement, then all rent, taxes, and additional fees minus a $1000 administration and cancellation fee will be refunded. Any transaction fee charged by bank and credit card companies is non-refundable. If the re-rental rate is made at a lower rate than the original Tenant agreed to, the refunded amount will be the difference between the original rental rate and the new rental rate minus $1000 administration and cancellation fee.

III d. Early Booking and Online Booking Cancellation Policy

We may offer the option to pay in full to receive an additional discount equal to your transient tax or cleaning fee if your reservation date is more than 120 days from check in date. You may also take advantage of the availability or special rate and/or offer to book the unit and pay in full before the 90-day period begins. In either instance, with any other offer that requires a full payment at the time of booking; your cancellation policy is based on section II a. above.

The 1st month rent plus cleaning fee and a $500 refundable security damage deposit is due 90 days before move in. An amount equal to 30 nights rent plus applicable fees will be authorized on your card at check in and the fund will be captured on the 28 day after move in. A 30 days’ written notice is required for termination or extension after the first 31 nights. Termination of the contract during the stay will result in 30 nights rent after the first 30 night’s cycle. The $500 security damage deposit is refundable under the terms and conditions listed in the contract.

III e. Cancelation Policy for Month-to-Month Rental

After check in, a 30 days’ written notice is required for termination or extension of the contract beyond the first 30 days. Without the cancellation notice, your card will be authorized for 30 nights’ rent. No refunds will be provided. We may offer or provide a complimentary property damage insurance with $1500 coverage. If offered, the coverage will be used after exhausting the $500 property damage deposit. The $500 security damage deposit is refundable under the terms and conditions listed in the contract.

V. Disclosure

Failure to notify us about any of the following is considered a violation of our contract and/or reservation terms and conditions.

You are required to disclose to us if:

  • You are an international traveler.
    An international traveler is one who does not have a U.S. Social Security Number. If you are an international traveler, your quote must show a 3% International Travelers Service Fee. You are required to notify us and request that we add this fee if the fee is not listed in your quote. Failure to notify us is considered a violation of our contract and/or reservation terms and conditions.
  • You are using a debit card.
  • You intend to use someone else’s credit card for making any rent payment with or without his/her knowledge.
  • You have knowledge that there will be any delay in collecting the funds.
  • You have defaulted on a payment within the last 90 days from the date that you sign the contract.
  • Any criminal conviction that prevents you from being close to children.

By making payment for security reservation deposit or toward the rent, and for renting any or all of our units/properties, you hereby represent to us that you are 18 years old or older and have fully read, understood and agreed to and accepted the Terms and Conditions listed above.

The most updated and or recent version of the terms and conditions (T & C) that has been provided with Reserving Party’s quote may be slightly different from the T& C listed in the contract or on the website. The Reserving Party agrees that the most recent version of T & C listed on our website overrides the older version of T & C.
