Introduction

We operate several Internet websites for our company called PMI Enterprises, LLC DBA: San Jose Executive Housing. All information provided in this Privacy Policy pertains to www.SanJoseExecutiveHousing.com (“website”) , www.YourCompanyPlace.com (“website”), www.YourSanJoseStay.com(“website”) and PMI Enterprises, LLC.(“Company”) DBA: San Jose Executive Housing. In using our websites, you agree to our use of your information as described in this Privacy Policy.

This Privacy Policy is an explanation of the information we collect, how we use it, and how the use of this information can benefit your experience on our websites and during your relationship with us.  The information outlined below will assist you in making informed decisions while doing business with San Jose Executive Housing.

(i) fulfilling reservation or information requests;

(ii) registering for San Jose Executive Housing program membership;

(iii) submitting a job application;

(iv) submitting a credit application or Rental Agreement;

(v) responding to communications from us (e.g., surveys, promotional offers, or reservation confirmations); or

(vi) registering for, or responding to a subscription request for our newsletter.  We endeavor to collect information only with your knowledge and with your permission if necessary.

(2) "Company’s website" shall mean all websites described herein, on which San Jose Executive Housing provides products, information and/or services.

(3) " You " shall mean all users of Company’s website and products/services, including Contractors, the Public or Clients and/or their authorized agents or representatives.  ‘You’ may also be referred to as ‘User(s)’.

(4) "Products, Information and Services" shall mean all products, information and/or services provided by San Jose Executive Housing, its advertisers or 3rd-party partners.

(5) "Registration Information" shall mean the Personal Information we request in the registration process, setting up your Account Profile and allowing you to access our products, information and services.

(6) "Account Profile" shall mean the Company’s website page(s) where the Personal Information that you have provided in the Registration process is displayed in compliance with your consent and agreement. It also means your individual account.

(7) “Company” may also be referred to in this Privacy Policy as ‘us’, ‘we’ and ‘our’.

D.  When your account is established, you will be issued a username and password that should be protected by you. No one from our Company will ever ask you for your password. You should never give your password to anyone who you do not authorize for access to your Account Profile.

E. If Company believes that the security of your personal information (including your username and password) becomes compromised, we will then attempt to notify you within a reasonable time. You consent to our use of the e-mail or phone numbers you have provided as a means of such notification. II.  Collection of Personally Identifiable Information

A.  In order to use certain services of our website, either now or in the future, you may be asked for, or you may choose to provide, certain personally identifiable information such as that described in paragraph I (C)(i) and elsewhere in this Privacy Policy.

B.  Company will not collect personally identifiable information from you while you use the website unless you voluntarily provide it to us or authorize us to collect such information.

III.  Use of Personally Identifiable Information

A. Company may use or disclose personally identifiable information in order to operate and manage our website, to provide services that you have requested, either now or in the future, or respond to your inquires or requests.

B. Company may also disclose personally identifiable information in the establishment or exercise of legal rights or defenses against legal claims, to comply with applicable laws or regulations, to comply with a valid legal process such as a search warrant, subpoena or court order or to investigate suspected fraud or a violation of these Privacy Policies.

C. Company will never sell or share your information to any third-party not affiliated with Company, without your consent, except in connection with the sale or merger of San Jose Executive Housing.

D. If you seek to have your rental charges invoiced to your employer or any other 3rd- party, Company may disclose personally identifiable data about you to that employer or 3rd-party and to any companies that assist the 3rd-party in processing invoices; when we report to credit card issuers, credit reporting and fraud checking agencies and debt collection agencies, Company may disclose personally identifiable data about you to them.

E. If you choose to do business with Company through, or with the assistance of, your employer's or any 3rd-party's travel agent, relocation company or other intermediary, we may disclose personally identifiable data about you to the employer or other intermediary to make, modify or cancel a reservation made by or with the assistance of the agent, to respond to inquiries from the agent on your behalf, to assist in any other issue that the employer or intermediary advises us that you intend for the agent to complete, or that such an agent would, as a matter of industry practice, typically complete on your behalf.

F. If your information is shared, as mentioned above, Company will limit the scope of information that is furnished, to the amount necessary for the performance of the specific function.

IV.  Collection of Non-Personally Identifiable Information

A. Company does collect and track certain non-personally identifiable information, including but not limited to, IP addresses and browser type, access times, domain names, usage habits and other information which does not specifically identify any individual.

B. SJEH may also collect other non-personally identifiable information about you, such as your use of our web sites, communication preferences, travel habits, aggregated data relative to your stays and responses to promotional offers and surveys.

V.  Use of Non-Personally Identifiable Information

Company may use and/or disclose non-personally identifiable information for any number of reasons, including but not limited to, working with business partners and contractors, and improving our website and services.

VI.  Cookies, Web Beacons and Pixel Tags; how are they used

A.  Company may utilize cookies, web beacons or pixel tags, when you visit our websites.

B.  Cookies are small text files that a website can write to your computer. We may use cookies to identify you. They are designed to save you time because they provide a custom experience for you, keeping track of the preferences you set, without having to reset them each time you return.  Company cookies will not damage your computer files, nor can they read other files on your computer.

C.  Company does not use cookies to store information such as bank account numbers, telephone numbers, or other information you provide. To maintain your privacy and not take full advantage of everything cookies offer, you can disable your browser's ability to accept cookies. Rejecting cookies might affect your ability to perform certain actions on Company’s websites and our ability to recognize your browser in future visits.

D. Company may use pixel tags, also called web beacons, to count the number of people that visit each webpage.  This information is used and reported in the aggregate and does not contain any personally identifiable information.  Company may use this information to improve our marketing and website content.

VII.  Your privacy with websites linked from our website

A.  Company website may contain links to various other websites. Each of these websites may have a Privacy Policy that differs from that of Company. The privacy practices of other websites linked to our website are not covered by this Privacy Policy and Company suggests that you view the privacy policies of each website that you visit through a link provided on our website.

B. If you submit your personal information through our Careers - Current Openings page at www.SanJoseExecutiveHousing.com or any pages produced by your search, you are visiting a co-branded page powered by Sonic Recruit. Your resume and any other personal information submitted are sent to the Company’s HR Department and will be shared within Company. 

C.  Company’s Neighborhood Info on each SJEH Property's Profile is provided by a 3rd-party. Your use of this information is not stored or collected by Company. 

VIII.  What about data security?

A.  Personal Information collected by our website is stored in secure operating environments that are not available to the public. Company employs the use of built-in firewalls (a combination of computer hardware and software) to keep unauthorized users from accessing information through our computer network. Only those employees and contractors who need access to your Personal Information in order to do their jobs are allowed access, each having signed confidentiality agreements. Any employee or contractor who violates our Privacy Policies will be subject to disciplinary action, including possible termination and civil and/or criminal prosecution.

B.  To ensure the security of your data, including address information and credit card or bank data, Company always uses industry-standard encryption technologies when transferring and receiving consumer data exchanged with our website.

C.  Company has instituted appropriate security measures that protect against the loss, misuse or alteration of information that Company has collected from you, including use of VeriSign’s 128-bit SSL encryption. For on-line purchases and transactions, credit card and bank account information provided to us is transmitted using SSL (Secure Socket Layer) encryption. SSL is a proven coding system that lets your browser automatically encrypt, or scramble, data before you send it to us. Absolutely no use, whatsoever, is made of credit card or bank account information aside from purchases on this website and there is no disclosure to 3rd-parties, except as required for credit card or bank account processing or as otherwise required under law or that you’ve agreed to in an ancillary written agreement with us

D.  We also protect information by placing it on a secure portion of our website that is only accessible by certain qualified Company employees or contractors. Unfortunately, no data transmission over the Internet is 100% secure. While we strive to protect your information, we cannot ensure or warrant the security of such information. The personally identifiable information we collect about you is stored in limited access servers. We will maintain safeguards to protect the security of these servers and your personally identifiable information.

IX.  Opt-out

A.  Upon termination of your Account, whether by Company or voluntarily, Company will automatically terminate website access to all personally identifiable information that you have provided to us. Such personally identifiable information will be maintained by Company and will be stored on a secure server, as required by law.

D.  Although Company will no longer send you marketing or other information after you opt-out, some information about you will be kept for a period of time in order to resolve disputes or troubleshoot problems.  Also, some information may be stored indefinitely on "back up" computer systems or within log files, due to technical constraints, or financial or legal requirements.

X. Spyware

Company never uses or installs spyware on your computer, nor do we use spyware to retrieve information from your computer.

XI. Newsletters

In the event that Company distributes electronic newsletters or RSS feeds, now or in the future, we will collect e-mail addresses and may collect zip codes and other information of all those who subscribe to these publications.
